Publication and Display Policy

If duplicated items are to be used for publication or display, additional fees apply and patrons will need to fill out a "Fees for Publication and Display Form."

When citing items from the Tyrrell Historical Library in any published work or display, please include the following line credit: "Courtesy of Tyrrell Historical Library, Beaumont, Texas." If the item is from an archival collection please also include the archival collection name and number. Be sure to follow any copyright restrictions on the materials and obtain proper permission before publication.

Copyright varies for published versus unpublished materials. Patrons take full responsiblity for making sure they abide by copyright rules when copying or publishing any materials at the Tyrrell Historical Library. For published works, United States copyright law includes a "Fair Use" provision under which, in general, approximately 1/3 of a published item can be copied without infringing upon copyright. However, this does vary. The following definiton of "fair use" is provided for the benefit of patrons:

"Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall includeŚ (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the copyrighted work." For unpublished works, archival staff will provide as much information as possible to the patron, but patrons take full responsibility for abiding by copyright rules.
